Cons. Stat. §9122 et. seq is the relevant statute for Pennsylvania expungements. Expungement is a legal process to clear your criminal record of convictions or arrests. Once a record is expunged, that record is inaccessible to the general public.
EligabilityIf you have been convicted of a summary offense of which you plead guilty, had the citation dismissed or completed an Accelerated Rehabilitation Disposition (ARD) you may be eligible. You must have satisifed all the terms and conditions of your sentence and be free of arrest or conviction for 5 years following your disposition.
If you are 70 years or older and have not been arrested or prosecuted for 10 years following your release from incarceration, your criminal history qualifies for expungement. Pennsylvania and Federal law allow for convicted criminal defendants to file a petition under the Post Conviction Relief Act for particular reasons. Here is the relevant statute, 42 Pa. Cons. Stat. § 9541 et. seq. It is important to note that this is an appeals process but is completely different and separate from direct appeals. However, much like direct appeals, PCRA petitions have strict time guidelines.
Many people wonder if they are eligible to file a PCRA petition. First, to determine eligibility, the convicted defendant, at the time relief is granted, must be on probation or parole, serving time in prison, or sentenced to death. After this element is met, time becomes very important. |
Time limitsGenerally there is a 1 year time frame given to file this petition. This means 1 year from the time judgment becomes final, including direct appeals. For example, there is a conviction at the trial level Jan 1, 2014. Defendant files a direct appeal and the conviction is affirmed February 2015. The year starts from February 2015, not January 2014.
Time limit exceptionsLike most rules, there are exceptions to the 1 year rule to file the petition. These exceptions are limited and very precise. Such exceptions are:
